TERMS OF SERVICE

Welcome! We are glad that you are taking the time to read these Terms of Service (the “Terms”). These Terms, together with your booking confirmation email (the “Booking Confirmation”), set out the legal terms on which Travel Services are made available to you through our Service. They also cover any interactions or communications you have with us through our Service.
Your use of our Service is subject to these Terms, and it is a condition of using our Service that you accept these Terms. To book a Service, you must also accept these Terms. If you do not accept these Terms, please do not use our Service or book a Service.
We may make changes to these Terms by updating them at any time, and your continued use of our Service after any changes come into effect will constitute your acceptance of the updated Terms. Any existing bookings will continue to be governed by the Terms that applied when the booking was made. We recommend that you save or print a copy of these Terms.
Definitions
In these Terms:
“we”, “us”, “our” or “Sands Group” refer to SANDS GROUP NEW ZEALAND LIMITED, a New Zealand corporation which provides the Service.
“Content” refers to all text, descriptions, reviews, photographs, images, videos, software, and other content submitted to our Service.
“our Group of Companies” refers to us, our subsidiaries, affiliates, and affiliated co-operatives.
“our Service” refers to the provision of our websites, mobile applications, and online tools, including our online hotel booking platform, customer service hotline, and other services.
“Travel Provider” refers to the all service provider orsupplier making available the Travel Services to you through our Service.
“Travel Services” refers to the travel services made available to you by the relevant Travel Provider(s) through our Service, such as hotel stays, cruises, or activities.
“you/ clients” refers to you, the person using our Service.
Please read these Terms carefully.
Section 1: Rules and Restrictions
In addition to these Terms, other terms and conditions provided by Travel Providers also apply to your booking (“Rules and Restrictions”). These Rules and Restrictions are provided to you before you make a booking and are incorporated by reference into these Terms.
To make a booking, you must accept the Rules and Restrictions of the selected Travel Provider, which may include payment obligations, cancellation policies, refundability, availability restrictions, and other conditions. Violating a Travel Provider’s Rules and Restrictions may result in cancellation of your booking, denial of access to the Travel Service, or loss of any money paid, subject to the Travel Provider’s policies.
In certain cases, Sands Group may act as the Travel Provider for the purposes of facilitating the Travel Service, in which case the Rules and Restrictions will be those of the underlying supplier.
Section 2: Using our Service
Our Rules
We provide our Service to help you find information about Services and assist in booking those Services. It is provided for no other purpose.
You agree that:
- You will use our Service only for personal, non-commercial purposes.
- You must be at least 20 years of age and have the legal authority to enter into contracts.
- You will use our Service lawfully and in compliance with these Terms.
- All information you supply is true, accurate, current, and complete.
- If booking on behalf of others: You will obtain their authorization prior to acting on their behalf; You will inform them of the terms applicable to the booking (including Rules and Restrictions) and ensure their compliance; and You will be responsible for paying amounts due, making change/cancellation requests, and handling all booking-related matters.
You also agree not to:
- Make any false or fraudulent bookings.
- Access, monitor, or copy any content on our Service using robots, spiders, scrapers, or other automated means, or any manual process.
- Violate robot exclusion headers or bypass measures to prevent or limit access to our Service.
- Take actions that impose an unreasonable or large load on our infrastructure.
- Deep-link to any part of our Service.
- Frame, mirror, or incorporate any part of our Service into another website without permission.
We may, acting reasonably, deny anyone access to our Service (or other sites, apps, tools, and services accessible under your Sands Group Account) at any time for any valid reason. We may also make improvements and changes to our Service at any time.
To access all features of our Service, you must create an account with us (or a Sands Group Account) and sign in. You must be at least 18 years of age and follow the account creation instructions provided.
If you have an account, you must:
- Safeguard your account information.
- Be responsible for any use of your account, including unauthorized transactions.
- Notify us immediately of any unauthorized use.
- Provide necessary information to comply with our legal obligations.
Your Sands Group Account allows access to other sites, apps, tools, and services offered by our Group of Companies using the same credentials. The relevant terms of service for those platforms will govern their use.
To delete your account, sign into your account on our Service and follow the account deletion process or contact us. For privacy rights, see our Privacy Policy.
We aim to make search results relevant. The default sort order is displayed on the search results page, but you can sort or filter results based on preferences.
Our Service may contain hyperlinks to websites operated by parties other than Sands Group. Such hyperlinks are provided for your reference only. We do not control such websites and are not responsible for their contents or the privacy or other practices of such websites. These Terms will not apply to your use of any third-party website that you access via our Service. Your use of any third-party website may be subject to additional terms and conditions, which we suggest you read carefully before you visit any such website.
Further, it is up to you to take precautions to ensure that whatever links you select or software you download (whether from our Service or other websites) is free of such items as viruses, worms, Trojan horses, defects and other items of a destructive nature. Our inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites or any association with their operators.
Section 3: Confirming a Booking
Your Booking Confirmation includes essential details of your booking, such as the Service description and price. We will send it to the email address provided during booking. If you do not receive it within 24 hours, please contact us.
Section 4: Payment
Price: The price of Services is as displayed on our Service, except in cases of obvious error. Prices are dynamic and may change, but changes will not affect accepted bookings unless there is an obvious error. We reserve the right to correct pricing errors. If an error occurs, we will offer you the option to keep the booking at the correct price or cancel without any compensation. You agree that we have no obligation to make available Travel Services to you at an incorrect (lower) price even after you have been sent a Booking Confirmation.
Taxes: Prices may include taxes or tax recovery charges. You may be responsible for local tax payable to local authorities or the Travel Provider. Tax amounts may change between booking and stay dates, and you shall bear for any increased rates.
Payment Processing: Payments are processed by Sands Group or the Travel Provider as indicated during booking. For bookings in New Zealand, payments are processed by Sands Group of Companies via third-party payment processors. The law governing payment transactions will be law of New Zealand.
Payment Verification: You authorize Sands Group or the Travel Provider to:
- Verify your payment method via pre-authorization, nominal charges, or other means.
- Charge your payment method upon verification.
Fees Charged by Banks: Banks or card issuers may impose fees for international or cross-border transactions or currency conversion. If you book using a card issued in a different country or currency, your card issuer may charge you an international or cross-border transaction fee. Kindly contact your bank or card issuer for details. Our Sands Group is not responsible for any fees.
Currency Conversion: Any currency conversion rates, if applicable, displayed on our Service are based on public sources and current exchange rates, which may vary between the time a booking is made and the time of travel. Such rates are provided for information purposes only and, while we seek to provide information that is correct, our Group of Companies does not guarantee the accuracy of such conversion rates because they are not within our control.
Alternative Payment Methods: We may work with providers of alternative payment methods (such as consumer finance companies), to provide our clients with alternative payment methods. Our Group of Companies does not endorse or recommend any alternative payment provider or their products or services. Our Group of Companies is not responsible for the content or the acts or omissions of any alternative payment provider. Your use of any such provider’s payment method is at your own risk and will be governed by such provider’s terms and policies.
Fraud: If we reasonably suspect fraud, abuse, or suspicious activity, we may request additional information. If confirmed, we may:
- Cancel bookings associated with your name, email, or account.
- Close associated accounts.
- Take legal action to hold you liable for losses.
Contact us regarding cancellations or account closures.
Section 5: Cancelling or Changing a Booking
Cancellation or Change by You: Cancellations or changes to a booking can be made by contacting us.
Other Cancellation or Change: We or the Travel Provider may cancel your booking if full payment or applicable fees are not received. Bookings may also be cancelled or changed due to overbooking, closures, or other issues. We will notify you and offer alternatives or refunds where possible, subject to applicable law.
Refunds: Refunds are transferred to the original payment method by the party that took the payment. Our fees are non-refundable unless stated otherwise or required by law.
Section 6: Liability
Nothing in these Terms limits, excludes, or modifies your rights, except where you are in trade and acquire Travel Services in trade, in which case you agree the Act does not apply.
Travel Providers are responsible for the Travel Services. Where Sands Group is the Travel Provider, our liability is limited to direct damages that are:
- Reasonably foreseeable by both parties.
- Actually suffered by you.
- Solely directly attributable to Sands Group’s actions.
Such liability will not exceed the cost paid for the Travel Service. Besides, Sands Group is not liable for:
- Your acts, errors, omissions, or negligence.
- Personal injuries, death, property damage, or other damages resulting from your acts, errors, omissions or negligence.
Sands Group is not liable for inaccuracies unless directly caused by us. Photos and ratings are for guidance only. Sands Group makes no guarantees about the availability of specific Services.
To the maximum extent permitted by law, Sands Group disclaims warranties that:
- the Service, servers, or emails are free of viruses or harmful components.
- the Service or content will be uninterrupted, error-free, or defect-free.
Sands Group's liability for any loss or damage shall be limited to direct damages that are reasonably foreseeable, actually incurred, and directly attributable to our actions. It shall not include any indirect loss, consequential loss, or loss of profits. For the aforesaid confirmed direct damages, compensation or shall be primarily covered by the insurance corresponding to the corresponding service.
Every instance of force majeure, including the interruption of means of communication or a strike will lead to the suspension of the obligations in these Terms that are affected by the force majeure event. In such a case the party affected by the force majeure event will not be liable as a result of the inability to meet such obligations.
You agree to fully compensate our Sands Group, its employees, and other people officially acting on its behalf, for any damages, losses, fines, costs or expenses (including reasonable legal and accounting fees), of any kind (“Losses”) that they incur or are liable for as a result of a claim being alleged or brought against them by a third party because of:
- your breach of these terms or the documents referenced in them,
- your violation of any law or the rights of a third-party,
- your use of our Service, or the Travel Services booked through our Service, and/or
- any content and/or information you provide or submit in connection with our Service.
We reserve the right to defend and take full control of any matter or claim that you are fully compensating Sands Group in respect of, and you agree not to settle any matter or claim without our written consent.
You agree not to hold Sands Group liable for disputes with third parties, except where the dispute is directly caused by us.
Section 7: Content
By submitting information and/or content to our Service, you grant Sands Group a worldwide, non-exclusive, royalty-free, perpetual, transferable, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, distribute, publish, and display the Content for any purpose.
You acknowledge and agree for any information and content that you submit (or authorise others to submit) to our Service, that you have the legal right and authority to do so, and to the extent that the information and content you submit (or authorise to submit) to our Service contains trademarks or other protected names or marks, that you have the legal right and authority to use such names, or marks.
You also grant Sands Group the right to legally pursue any person or entity that violates any intellectual property rights in, or attributable to, your information and content.
Content is non-confidential, non-proprietary, and not misleading. No confidential or fiduciary relationship is created beyond these Terms. Content must comply with our Content Guidelines.
You waive any moral rights in Content to the extent permitted by law. Sands Group may exercise rights (for example: to use, publish, display, delete, etc.) to information and content without notice to you.
Section 8: Intellectual Property Policy and Notices
All content on our Service is owned by Sands Group or licensed to us. Sands Group, its logo, and other marks are trademarks of SANDS GROUP NEW ZEALAND LIMITED. Other marks may belong to their respective owners. We are not responsible for content on websites operated by parties other than us. Reproduction of our Service is prohibited to the maximum extent permitted by law. Copying or accessing our Service for non-personal, commercial use is prohibited without permission.
We respect intellectual property rights and do not permit infringement on our Service. Report brand infringements to the contact as stated below.
Section 9: Software Available on our Service
Any software downloaded from our Service or app stores is owned by Sands Group or licensed. We only grant a limited, personal, non-exclusive, non-transferable license for using our Service. Reproduction or redistribution is prohibited.
Section 10: Artificial Intelligence
We may use AI, including generative AI, for features like recommendations or fraud detection, in partnership with third-party providers. Data is processed per our Privacy Policy. See our Privacy Policy for details on data processing and rights.
AI-generated content is owned by Sands Group. Users receive a limited, non-exclusive license for personal, non-commercial use. Unauthorized use is prohibited. Kindly be informed that AI-generated content is provided “as-is” and may not be accurate or complete. Sands Group disclaims liability for losses from reliance on such content, to the extent permitted by law.
Section 11: Your Privacy and Personal Information
We process personal information in accordance with our Privacy Policy. You agree to protect personal information with reasonable care and assume liability for its misuse, to the extent permitted by law.

Section 13: General
These Terms are governed by New Zealand law. If unresolved, you may pursue remedies under New Zealand law, such as through the Disputes Tribunal for small claims or other courts.
Prices do not include travel insurance. You are responsible for obtaining adequate insurance.
Our delay or failure to enforce any provision does not waive our right to do so later.
If any provision is invalid, illegal, or unenforceable, it will be severed, and other provisions remain unaffected.
These Terms constitute the entire agreement regarding our Service, superseding prior communications.
We may assign our rights and obligations without your consent or notification to you, but you may not, without reducing your rights.
These Terms are not enforceable by third parties unless expressly stated.
Provisions imposing ongoing obligations survive termination.
